Buying, Selling & Equipment
Where CQ Gram permits users to discuss, advertise, buy, sell, or exchange equipment, CQ Gram generally provides the communication platform only. Unless expressly stated otherwise, CQ Gram is not the buyer, seller, manufacturer, dealer, broker, or guarantor of user-to-user transactions. Users are responsible for verifying the other party, confirming equipment condition, complying with applicable laws and import/export requirements, arranging payment and shipping, and protecting themselves against fraud.
User-to-User Relationships
CQ Gram facilitates communication between users but is generally not a party to private relationships, arrangements, transactions, or contracts between users. Using CQ Gram does not create an agency, employment, partnership, joint venture, or fiduciary relationship. Users remain responsible for their own interactions and decisions.
Disclaimer of Warranties
To the extent permitted by law, CQ Gram is provided on an “as available” basis. CQ Gram does not guarantee that:
- the Platform will always be uninterrupted;
- every user is who they claim to be;
- every callsign is current;
- every post is accurate;
- every transaction between users will be successful;
- every piece of content will remain permanently available; or
- every technical feature will always operate without error.
Nothing in these Terms limits rights that cannot lawfully be excluded.
Limitation of Liability & Indemnity
To the maximum extent permitted by law, CQ Gram and its operator will not be liable for indirect, incidental, consequential, special, or exemplary losses where such liability may lawfully be limited — including losses arising from user-generated content, user-to-user disputes, equipment transactions, reliance on another user’s statements, unauthorized third-party conduct, temporary interruptions, third-party services, or loss of content users were expected to back up.
Users remain responsible for their own unlawful conduct and content. To the extent permitted by law, users may be responsible for claims, losses, or reasonable costs resulting from their unlawful content, fraud, intentional abuse, or infringement of third-party rights. Nothing here removes mandatory consumer protections.
